Politician Norman Baker served 28 years in elected office – 18 as an MP. He lost his seat at the general election in May this year.

In 2010, as part of the Conservative & Liberal Democrat Coalition government he was appointed Parliamentary Under-Secretary of State for Transport.

In 2013, he was appointed Minister of State for Crime Prevention at the Home Office. That means he was based at the Home Office, preventing crime – not that he was preventing crime happening within the Home Office.

In 2014, he resigned, citing conflicts with Home Secretary Theresa May.  (Bear this fact in mind later.) He was quoted as saying that being the only Liberal Democrat at the Home Office was like being “the only hippy at an Iron Maiden concert”.

The music analogy is not random. For the last 20-odd years, he has been lead singer and lyricist for The Reform Club, a band which he describes as playing “retro-1960s pop” music.

There is a video of them on YouTube, performing at Piccadilly Circus in 2013.

“Did you want to be a rock star?” I asked him yesterday in Soho.

“No,” he told me. “That’s a ridiculous thing to want to be. I just wanted to have some fun. It’s a therapy, a release. It’s like playing pinball. I’ve got a pinball machine.”

“I have never,” I said, “seen the point of playing pinball.”

“It’s a bit like playing snooker or playing in a band,” he told me. “You just switch off. It’s like meditating for an hour.”

“You are,” I said, “President of the Tibet Society and you were a member of the UK All Party Parliamentary Group for Tibet. Why?”

“Well,” he replied, “it’s a matter of human rights and justice and trying to take on bullies.”

“But you’ve been quoted,” I said, “as saying: Compromise is a useful thing.”

“It is a necessary thing. No-one gets 100% their own way.”

“But you have to,” I said, “do deals with nasty people.”

“Yes, you do. Sometimes you have to work with them.”

“In the Home Office?” I asked.

He did not reply.

“You seem to be a terribly principled man,” I said. “Don’t you compromise your principles by talking to and doing deals with shits?”

“Well, otherwise,” he replied, “they run the show themselves. People asked why didn’t I resign, why didn’t the LibDems resign from the government? The answer is because all the people you don’t like would be left there and we’d be gone. Do you really want to hand the government over to the people you disagree with most?”

“So you’re a left wing LibDem,” I said.

“Yes.”

“The LibDems have got lost somewhere,” I said. “I don’t know where they are in the spectrum.”

“We need them,” he replied. “We need a liberal voice.”

“So what’s the book you’ve just written? – Against The Grain?”

“It is,” he said, “a political memoir. 1987-2015.”

“Why write it?” I asked. “To justify your time in office?”

“No, to close a door on it. And so the public know what happened. It’s the first Coalition book and shows how it worked. But it was quite selfish of me in a way. It was cathartic, rationalising the last 28 years in my head, putting it in some sort of order and shutting the door on it.”

“Do you have an elevator pitch for the book?” I asked.

“Truthful, controversial, humorous, contrary, pleasingly insulting. That sort of thing.”

“Is that a description of you or the book?”

“Me… Well, both.”

“You have said you’re not interested in going back into politics.”

“I’m not. I have done 28 years in elected office.”

“But, if you’re really passionate about changing things…”

“I’ll do it in a different way. I’ll write books or lecture. Tony Benn famously said he was leaving the House of Commons to spend more time on politics.”

“I’m not an admirer of Tony Benn,” I said. “He was a bit too far up his own arse.”

“It’s a good quote, though,” said Norman.

“Do you think the book you have written will have as big as an effect as being an MP?”

“Probably not.”

“Books are on the way out,” I said. “You can only have an effect if you’re on TV.”

“I don’t have to have an effect. I need to do what I think is right. And I need to put myself first for a bit. I spent 28 years serving the public. I don’t want to sound too grand about it, but that’s the sum of it. You don’t become a LibDem if you are after power; you do it from the ground up. If I can make a pittance writing books or doing music, then that’s fine. I don’t have to be ‘out there’. I’ve done that.”

“The irony,” I said, “is that people became LibDems thinking they would never actually be in power and then they ended up in the Coalition government.”

“We had a big effect. You can see the effect we had, because it’s all being undone by the Tories.”

“What,” I asked, “is the worst thing they’re un-doing?”

“Well, reducing the tax credits is clearly just vicious.”

“It seems to me,” I said, “that, with the tax credit thing, George Osborne is undermining his own chances of becoming Prime Minister. Boris Johnson is going to become Conservative Party leader now…”

“Well,” said Norman, “out of all the candidates, it may sound unlikely but I would rather have Theresa May. At least she’s got principles, even if you don’t agree with them. Osborne is just terrible. Boris is a nasty bit of work and Osborne is just power crazy.”

“But being power crazy is OK in politics, isn’t it?” I asked.

“Well, Osborne is interested in two things: becoming leader of the Tory Party and winning the 2020 Election and everything is being sacrificed to those two ends. That is not in the interests of the country; that’s the interests of Osborne.”

“I think Boris will make a good Prime Minister,” I said, “because…”

“Boris has not been a very good Mayor of London,” Norman told me. “He’s had his back covered by a lot of people. He’s made a lot of mistakes.”

“Why is he a nasty piece of work?” I asked.

“You need to listen to the interview with Eddie Mair.”

“What does it show?” I asked.

“Well, it shows he’s a nasty bit of work.”

“Did you used to read Scallywag magazine?” I asked.

“Yes, in fact, the guy who wrote it (Simon Regan) sent me some information.”

“About what?’

“About MPs allegedly involved in child sex exploitation.”

“You didn’t live in Dolphin Square?”

“No.”

“The male prostitutes allegedly in that place…”

“That’s one thing, There’s nothing wrong with that. I take the view, if you’re over 18, you can make up your own mind what you do.”

“The scandal Simon Regan got wrong, though,” I said, “was the John Major affair with…”

“…Edwina Currie,” said Norman.

“No, the caterer,” I said. “Scallywag wrongly kept going on about Claire’s Kitchen. Everyone was thrown by that.”

“I think it’s nobody’s business,” said Norman. “I feel quite strongly about that.”

“John Major was married, though,” I said.

“But so what?” said Norman. “You’re entitled to a private life. Mitterrand and everyone else has all these affairs and no-one worries about that. The question is: Are you, in public life, doing what you are supposed to do for the benefit of the public? Yes or No? End of question.”

“I think,” I said, “that the problem was John Major was talking about Victorian Values a lot at the time.”

“No,” said Norman, “to be fair to John Major, it was Back To Basics and, by that, he meant things like the Three Rs in education, but it was taken by the press to mean some sort of puritanical view. I don’t think he ever meant that.”

“John Major,” I said, “seems to have grown in stature since he stopped being Conservative Party leader.”

“Well, he is not mad.,” said Norman. “He’s the only Prime Minister in recent times to leave office not mad.”

“She was hopeless,” said Norman. “She went to the Sistine Chapel with all the other European leaders on some EU trip and they were all in there admiring the Michaelangelos, or pretending to, and there was silence and she barked out: My goodness! How do they keep the floors so clean?”

“That’s surely good PR,” I said. “…I’m the woman next door.”

“Completely gormless, actually,” said Norman.

“Mrs Thatcher wasn’t a great brain,” I suggested. “She got where she got by being really hard working. But no Einstein.”

“She was hard-working,” agreed Norman. “She wasn’t Einstein, but she thought she was in some ways: I’m a chemist, therefore I understand this.”

“By the end,” I said, “she thought she knew better than the public.”

“Yes,” said Norman. “Blair had the same fault. It’s a sign of madness.”

“Blair talked to God,” I said. “and, it seems, God does not always make good decisions.”

“Well,” said Norman, “Blair became a Catholic and, within two weeks was telling the Pope he was wrong, which must take some medal for arrogance.”

“You asked questions in the Commons on UFOs,” I said, “which seems totally out-of-character.”

“I didn’t ask any UFO questions,” said Norman. “This is a slur put about by my enemies. I asked about expenditure by the Ministry of Defence on a particular area. I was interested in the potential of other countries invading our airspace without being detected by radar. I’m afraid you’ll find that people who want to try to disagree with my arguments seek to character assassinate me. That’s what people do. They’ll go for the player rather than the ball. It’s a standard technique.”

“It must be a relief not being in Parliament,” I said. “You don’t get all that crap.”

“Yes. I enjoyed it and I achieved quite a lot, but I’ve now shut the door on it and I’m feeling rather better for it. The new Reform Club album is out on January 16th. It’s called Never Yesterday.”

Paying publications to review your show is like having paid-sex with a famous wit

Someone told me about this yesterday.

I said: “Are you sure it’s not an April Fool prank?”

“If it is, it’s a day late,” the person told me.

And this is no surreal joke.

Just like my Frank Sanazi blog yesterday – which included Jesus Christ flying in from Glasgow for Hitler’s birthday – this is true.

I was more than a little surprised to see on the Chortle comedy industry website these words:

“This year we make explicit what we’ve always tried to do anyway, and promise to review any show that spends at least £250 on advertising on Chortle. To avoid any Daily Telegraph-style conflicts of editorial interests, we won’t make any promises as to which reviewer will see a show, when it’ll appear – or most crucially whether we’ll like it! And you’ll have had to have settled your bill before the Fringe, so you can’t back out if you don’t like what we’ve written.”

Each to his own, but I think once you allow people outside the publication (the performers themselves) to dictate which shows will receive reviews (by, in effect, paying to be reviewed) you have lost editorial control.

There is a story which is told about George Bernard Shaw or Winston Churchill or a variety of other fairly witty people in various versions…

There is a dinner party. The conversation turns to the concept that ‘Everyone has their price’ and the famous man turns to a lady sitting at the table and says – purely as a matter of intellectual theory, in order to spur the debate along – “If I offered you £10 million to sleep with me for one night, would you accept?”

“I suppose,” the lady says, laughing, “for £10 million, I would.”

“In that case,” says the great man, “here’s ten shillings. Sleep with me tonight.”

“What kind of woman do you think I am?” the outraged lady replies.

“We have already established,” the great man says, “what type of woman you are. We are now merely haggling over the price.”

There is no actual moral or logical difference between saying: “If you pay me £250, I will guarantee to review you rather than another show which I could have chosen to review” and “If you pay me £500 I will allow you to veto what I say in my review” or “If you pay me £1,000 I will let you write your own review as a press release which I will print word-for-word.”

By receiving payment to get reviewed, we have already established what type of editorial judgment a publication has. We have established the principle. We are merely haggling over how much it might cost to influence the content.

If an act pays £250 (for whatever reason) to guarantee a review, the publication has relinquished editorial responsibility by letting an outsider decide which shows (among so many others) will be reviewed. If a publication had time and space to print 500 reviews at the Edinburgh Fringe and 500 acts were happy to pay £250 to get reviewed, then that publication would not be deciding to review any shows on the basis of merit or perceived interest. It would be merely selling space to acts to advertise their wares via reviews. Even if the act has no control over the content of the review, it has still turned an objective review into a paid-for advert.

Over the years, as reported in Chortle, some comedy venues have attempted to charge performers a fee to perform in their clubs or to have the act guarantee that a certain number of their friends will pay for tickets to their show – this has rather sniffily been described as ‘pay-to-play’.

There is no difference that I can see between ‘pay-to-play’ and ‘pay-to-get-reviewed’. In both cases, the result may backfire – the audience may hate the act or the reviewer may hate the act. But the principle of payment-to get-exposure is the same.

On Facebook, performer Richard Vranch has pointed out that the Chortle idea of being paid by acts to review their show is not new. In June 2012, Chortle ran a news item headlined:

Comedian Caimh McDonnell was pulling a publicity stunt but interestingly called his scheme ‘undoubtedly a new low for British journalistic integrity’. In fact, to avoid actual bribery, Caimh said he would not pay the £100 to publications but – up to a maximum of £3,000 – he would pay the money to the Macmillan Cancer Support charity. Fair enough.

In May last year, Chortle ran this report:

He has been vehemently opposed to competitions in comedy, calling them a ‘malignant and destructive influence’ on the artform. Yet last night, The Stand comedy club owner Tommy Sheppard welcomed the Deuchars Beermat Fringe competition to his venue in Edinburgh, with heats in Glasgow and Newcastle to follow next week. And, unlike most competitions that keep the commercial side separate, this one insists that all acts must ‘weave’ the name of the sponsor into their set. But Sheppard told Chortle he saw no conflict as the Deuchars competition was across all performance genres: ‘We’re convinced it’s not a comedy competition,’ he said. ‘The majority of people taking part last year – and so far this year – are musicians.’ And the winner of last night’s heat? A comedian, Ross Leslie.

Paying £100 for a review… or paying £250 for the publicity of a review even though you don’t control content… or saying you don’t believe in competitions then hosting competitions which force acts to include brand names in their performances…

It all seems much of a muchness to me.

But, then, who am I to quibble? On my Facebook pages yesterday, I posted:

There are a lot of talentless fucks worming their way into the business. When a comic sends me a list of credits and reviews and they list Broadway Baby, The List and all the other rags that send 20-year-old reviewers out to review, my first thought is You’re probably shit. I would pay these reviewers not to review my show.

“So you are telling me all comedians are sociopaths?” I asked comedian Lindsay Sharman.

“Not all,” she said. “Just some.”

“I never know,” I told her, “the difference between psychopaths and sociopaths.”

“I think it’s the level to which they have violent impulses,” said Lindsay. “Shall I go through the symptoms?”

“Simpsons?” I asked.

“Symptoms,” said Lindsay. “The main one is a lack of empathy: an inability to understand other people’s emotions. Hence a lot of them become mimics, so they can move throughout society easily. They become excellent mimics of what they think other people want to hear and see. So a lot of them are very charming and have very close relationships which, at some point, break down because the other person ends up getting mistreated by them. The sociopath will emotionally manipulate people in order to go for their weaknesses and vulnerabilities to bond them closer to them.”

“Just sounds like men with women and vice versa,” I suggested.

“There are other things that tie them to the comedy community,” said Lindsay. “They’re very promiscuous, because they don’t necessarily form very close bonds. And there’s a high incidence of bi-sexuality…”

“I’ve not noticed that in comedians,” I said, surprised. “I mean the bi-sexuality.”

“Yeah, well, maybe not all comedians,” said Lindsay.

“I was reading the other day,” I said, “about a high incidence of promiscuity among people in a particular bank branch in Regents Street. Someone who worked there was saying everyone was bonking everyone else.”

“That’s just them self-aggrandising their workplace,” said Lindsay. “Look at us! We’re all bonking all the time!

Sociopaths are also,” she continued, “constantly observing – to understand human behaviour so they can absorb it. It’s this outsider position while desperately trying to be an insider and there’s also an element of game playing to the whole thing. They seem to go through life like a video game – like it’s all about levels and achievements.”

“But bankers are the same aren’t they?” I asked.

“Yes,” agreed Lindsay. “And the reason why there’s a lot of sociopathic behaviour among financiers and CEOs is because they’re not risk averse. The things that would scare the crap out of us, they just do. If it doesn’t work it doesn’t matter: they’ll just try another thing. They’re accumulating power and points and they don’t care if other people are adversely affected.

“The people who brought down banks and wiped out people’s pensions probably are not kept awake at all at night by that. They’re probably just planning their next move to get back on top of the heap.”

“But comedians are terrified of everything,” I said. “I’ve seen comics virtually shit themselves before they go on stage.”

“There’s adrenaline,” countered Lindsay. “A lot of sociopaths will create difficult situations for themselves because they enjoy the challenge and the adrenaline associated with getting out of those situations. I’m not saying all comedians are sociopaths but, in a lot of the different problems which different comedians have, I think there might be an element of it. Sociopaths have also got a very high regard for themselves. Quite narcissistic.”

“But,” I said, “comedians have got terrible problems of self-doubt.”

“They say that,” agreed Lindsay, “but they think that’s what people want to hear. It’s that duality of thinking you’re constantly screwing it up while thinking you’re the best thing in the world. They’ve got rock-solid self-esteem while knowing they can screw up quite a lot.”

“So comedians have simultaneous low self-esteem and high self-esteem?” I asked.

“I think that’s a very comedian thing,” said Lindsay. “There’s an arrogance in even trying it in the first place. And part of sociopaths’ charm is that they’ll use humour as a mechanism to hide the fact they have no feelings. They know people are attracted to humour.

Surgeons. Are they also a bunch of sociopaths or psychopaths?

“Some other industries do attract sociopaths. The financial world. Any world which can bestow prestige and in which it’s helpful to not have too many empathic feelings. Top surgeons who carve into bodies all the time and have to see the body as just a collection of tubes. Anyone who climbs to the top of the heap.”

“But surely,” I said, “everyone is trying to climb to the top of some heap, even if it’s small and parochial.”

“Well,” replied Lindsay, “it has become a bit hip to say you’re on the autism scale. It might make more sense to say we’re somewhere on the empathy scale. I like to think of myself as an empathic person but, if I was really empathic, I would be a vegetarian. I am quite happy to eat animals which have been slaughtered.

“Intelligent sociopaths who have been raised in empathic environments will try and replicate what an empath does, though they might only go for free range eggs or something. Whereas a lot of people who are empathic use their emotions as a terrible excuse for atrocities – like blowing up an anti-abortion clinic. That’s all about emotions and nothing about logic. In fact, either end of the scale is not great, really.

“Maybe comedy commissioners should be recruited from fallen financiers who have taken too many risks. The trouble with the current UK comedy commissioning scene is that is seems to be populated by a load of scared people. They all seem scared to lose prestige, to lose their job, to look like an idiot. They don’t take any risks.

“There have always been people scared in their jobs, not willing to risk things, but I just think it’s getting a bit endemic. And now they’re all thinking: Oh! We’ve got to be relevant because apparently this thing called ‘the internet’ is taking over. So now they do things like look at YouTube hits and go: Oh! Let’s give him a programme! Hence Dapper Laughs. He wouldn’t have got a programme if it hadn’t been for panicked TV commissioners. It’s idiotic. If they did what the internet does, they’d have wall-to-wall pandas on slides and kittens falling off tables.”

“When you say comedians are sociopaths, though,” I said, “you’re describing any person really. Dustmen probably want to get to the top of their profession.”

“No,” said Lindsay. “I think a lot of people are very happy doing what they’re doing. They have different priorities. I’ve had quite a few different jobs in my time and the majority of the people I’ve worked with outside comedy are happy doing what they’re doing and they’d prefer not to have the stress of extra responsibility. I don’t think everyone is hungrily ambitious. You’ve probably spent too much time around comedians, John. You’re starting to think most people are ambitious.”

“No. I think most people are barking mad,” I told her, “and that’s the good side of them. I think most comedians are terrified.”

“Like I said earlier,” replied Lindsay, “I don’t think all comedians are sociopaths, “just that there might be a high incidence. The incidence of sociopaths and psychopaths among the top tier of financiers is supposed to be much higher than in the general population. And I think that might be the case with comedians too.”

“Other comedians,” I said,  “are going to hate you implying they might be sociopaths.”

“Some of them definitely are. Some of the ones who are a bit more ruthless and careerist – maybe they have an element of it? That’s not to say there’s anything wrong with being ambitious. I find the more successful comedians think: I know exactly what works. I know my schtick. And they do it with such conviction and belief in themselves that audiences can get swept up in it.”

I said: “It sounds like being a sociopath might help in career terms.”

“Probably,” Lindsay replied. “If you’re not so bridled by morality and guilt, then you…”

“Guilt?”

“If you have absolutely no remorse for anything, if you don’t care about the pain you might cause others, then you probably will be incredibly successful in business. And comedy. And you won’t be hung up on artistic integrity – Screw you! I’m going to do this because it will give me greater exposure and more money and that’s what it’s all about.”

So are you a sociopath?” I asked.

“I don’t think so,” said Lindsay.

Fanny & Stella: “I had wanted to write a book which was completely gay”

Last night, I had a gay old time with Chaps in Dresses.

Perhaps I am old-fashioned at heart. Like many others, I lament the change in meaning of the word ‘gay’.

But, last night, the highly esteemed Sohemian Society hosted an evening billed as Chaps in Dresses.

The evening started with the recitation of a limerick from famed Victorian porno publication The Pearl, circa 1879-1880.

The swine, in surprise,
Murmured “God blast your eyes,
Do you take me for Boulton or Park?”

Fanny and Stella bookLast night’s Chaps in Dresses was a talk by writer Neil McKenna nimbly plugging his new book Fanny & Stella: The Young Men Who Shocked Victorian England about Boulton and Park.

The Sohemian Society meeting took place in an upstairs room at the King & Queen pub in Foley Street in what I think estate agents now call North Soho. It was a stone’s throw – or as Neil McKenna put it – “a strong ejaculation away” from 19 Cleveland Street, the site of a famous Victorian male brothel.

Fanny & Stella is a merry tale of Victorian men who liked to dress as women – Fanny and Stella were actually Frederick Park and Ernest Boulton who, according to the book’s publicity, had their “extraordinary lives as wives and daughters, actresses and whores revealed to an incredulous public” at a show trial in Westminster Hall “with a cast of peers, politicians and prostitutes, drag queens, doctors and detectives” in a “Victorian peepshow, exposing the startling underbelly of nineteenth century London.”

But I was equally interested in Neil McKenna’s tale of the problems he had getting the book published. He gave a health warning before his talk:

“When I did a talk in Kirkcudbright in Scotland,” he explained, “in a hall where the average age was about 82, they provided not one but two defibrillators. We got through without mishap but then, a couple of weeks ago at Gay’s The Word, we were doing very well when suddenly a lesbian fainted and had to be carried out. Then I did a talk at Waterstone’s Gower Street and I was just getting into my stride when a woman rather ostentatiously walked out.

“We must also spare a thought for poor Virginia Blackburn, a reviewer for the Sunday Express who read my book and said she was no prude but felt she had to skip over some passages – which begs the question What sort of ‘passages’?”

Neil McKenna believes that, until very recently, gay history has been largely written by heterosexuals who “have an agenda” but, to an extent, things have slightly improved. For example, this month is Lesbian, Gay, Bisexual and Trans-Gender History Month – a title which, Neil McKenna admits, is “a little bit of a mouthful”.

“Gay history, as generally told,” Neil said last night, “is a history of criminality, repression and punishment but, actually, gay history is also the history of people who fall in love, people who go out and have sex with each other, people who create a sub-culture and who form an identity. And that’s really what I wanted to write about, although the story in the book is framed within the context of a criminal trial.”

Ernest Boulton and Frederick Park were arrested in drag outside the Strand Theatre in 1870 and put on trial in 1871.

“My publishers, Faber, were a little ‘challenged’ by the content of the book when I first delivered the manuscript,” Neil admitted last night. “They went a bit green and then a bit white and then they went a bit blue and, more or less, said This is not at all what we were expecting. I said Well, you’ve met me. What were you expecting? Hardly Patience Strong.

“So they were all a bit tense and we had quite a few tense weeks of discussions and chit-chats. My agent sort-of abandoned me and said: You’re on your own. But it was all resolved because Stephen Page, the CEO of Faber, read the book and announced that he liked it. So suddenly everyone liked it, which was rather useful.

“Instead of having a book they were rather sceptical about – I think largely because it’s an in-your-face book – they got behind it and I think it’s quite new and quite exciting for Faber to publish a rip-roaringly gay, unmediated, utterly-butterly book about gay men, drag, bottoms, fucking and cock-sucking.

“I had wanted to write a book which was going to be completely gay. I was fed up with writing stuff that had to be seen through a prism of heterosexuality. I just thought I’m going to go for it. I’m going to write a book that is totally and completely gay. I’m going to call Fanny and Stella ‘she’ because that was what they called themselves… and that was a little bit of a sticking point again at various stages of the publication process. I much preferred to call them ‘she’ and that was a battle I won.

“I wrote the book because I’d finished my book on Oscar Wilde and I was looking for another subject. I had mentioned Fanny and Stella in the Oscar Wilde book and I wondered if there was any mileage in them.

“I discovered there was a full trial transcript in the National Archive, put together with maybe 30 or 40 depositions and maybe 30 or 40 letters. It’s remarkable, because most Victorian trials don’t survive. Sometimes there’s a shorthand account of a trial or part of a trial but, usually, we’ve only got fragments. I think that’s because the Public Record Office was bombed in the War and lots of stuff was destroyed. But also lots of stuff was never kept. It was never considered important to keep. So I’m very grateful to the the succession of people at the National Archive who thought this was – maybe – important to keep.

“That was my first step… and then I found curious things like a ledger of Treasury payments to some of the witnesses in the trial and to some of the policemen in the trial. It was strange, because normally the Treasury shouldn’t be paying witnesses, even in 1870. So why were there payments to some of the witnesses? That started little alarm bells going off in my head. And, as I probed and probed, I discovered that there was… well, Fanny and Stella were accused of conspiracy to induce and incite men to have sodomitic sex with them.

“But there was also a parallel conspiracy… the police, probably the Home Secretary, certainly the Attorney General and perhaps Sir Richard Mayne, the Chief of the Metropolitan Police had all conspired to create a show trial, to make an example of two young cross-dressers.

“I discovered Fanny and Stella had been followed for a year. They had been under surveillance for a year. In the MePo files – the Metropolitan Police files – in the National Archive, there are also surveillance reports not of Fanny and Stella but of various other people who were considered a threat to the State. So we know in the late 1860s, 1870s, Britain was becoming a little bit of a police state, because lots of people were being surveilled.

“But why were Fanny and Stella such a threat? What was the problem with two very silly young men? They’re not intellectuals, they love to dress up, they love to perform, they love the theatre and when they weren’t in the theatre, they were on the streets selling their bottoms to raise a bit of cash to buy frocks so they could perform. They were very silly boys. They were not a threat. They were not terrorists. They were not Fenians. So why bother?

“The death penalty for buggery was only abolished in 1862, eight years before the arrest of Fanny and Stella. I think it has something to do with sexual identity.”

But, even so, why the big hoo-hah, the conspiracy and the trial in Westminster Hall? And why did the jury find them innocent after deliberating for only 53 minutes?

“You’ll have to read my book,” Neil McKenna said last night.

The English legal system and British government out grazing

Am I alone in wondering why Starbucks is getting so much stick about not paying its taxes in the UK?

And Google. And Amazon. And (getting surprisingly less stick) Vodafone.

Yesterday, Janet Street-Porter (whom I rate vary highly) wrote a piece for The Independent headlined GOOGLE, AMAZON, VODAFONE AND STARBUCKS MIGHT NOT BE BREAKING LAWS. BUT THEY DESERVE TO BE PUNISHED. 

Why?

Why should anyone or any company be punished for not breaking any laws? Should you be punished for not breaking the law? Should I be punished for not breaking the law?

Admittedly, Starbucks’ PR is utter shit.

Saying they will, out of the goodness of their corporate heart,  pay a flat sum of £20 million totally unrelated to any percentage of their profits is simply shooting themselves in their very large, clown-like feet.

But, if the law allows them to do what they have been doing – paying only 1% of their UK profits in tax over the last 14 years – then do not blame Starbucks, blame the British government, blame Parliament and blame the taxman.

If the law is not what the government and the public want, then change the law. And do not change it retrospectively.

If I park my car outside a house and the government or local council does not want me to do that, then paint a double yellow line on the road. Don’t paint a double yellow line on the road and then fine me for parking illegally on the road before it had a double yellow line and when parking there was perfectly legal.

Jimmy Carr got crucified in the same way.

His accountant sorted out his tax perfectly legally and in the most efficient way for Jimmy… and then the government complained he was wrong in acting perfectly legally…

If the law is an ass, then don’t blame the people or companies who ride the ass. Don’t ask people to kiss the English legal system’s ass. Change the law.

What’s all this bullshit over comedian Jimmy Carr paying 1% tax on his millions by exploiting a perfectly legal tax loophole?

If the government has passed laws which have loopholes which the Prime Minister considers “morally repugnant”, then the government should close the loopholes, not try to appear to be morally superior by criticising people who are acting perfectly legally.

British-based American comedian Lewis Schaffer said to me when this Jimmy Carr story first blew up: “What’s the big deal? In America, it’s not an option – it’s seen as a patriotic duty to pay as little tax as possible.”

Bloody right.

If Jimmy Carr is given the option by Parliamentary law to pay either 1% tax or 40% tax, why is it morally repugnant of him to pay 1%?

It is not morally repugnant; it is common sense to do it.

It would be financially and intellectually stupid of him to pay anything more than 1%.

If the politicians do not like it, then they should change the law.

The Labour-leaning Daily Mirror newspaper today says that “against a backdrop of cuts that threaten jobs and livelihoods, struggling Britons will agree with David Cameron that Jimmy Carr’s tax avoidance was morally wrong.”

I suspect this is utter bollocks. Where are these Britons who want to give money to the Inland Revenue and who think anyone should pay 39% more tax than they actually have to?

The Mirror is on stronger ground when it says: “Hard-up families being stripped of their child benefit will be furious that Mr Cameron’s rich pals are allowed to get away with paying just one per cent tax,” especially as “his stockbroker dad Ian used tax havens in Panama City and Geneva to build up the family fortune,” and that “the PM appointed billionaire Sir Philip Green as a Government adviser despite complicated tax arrangements which mean his High Street retail empire is owned by his Monaco-based wife.”

I am sure the Labour Party front bench is equally hypocritical and I would be interested to see how much tax the owners of Mirror Group Newspapers are paying.

Are they sending letters to the Inland Revenue saying: “I notice that I legally only have to pay 5% tax, but I would like to donate another 35% to the nation in these hard times”?

Perhaps, to be morally responsible, while Britain is in a recession caused by highly-paid bankers with good accountants, Westminster politicians – who are paid above the average wage – should donate to the Inland Revenue the difference between their salaries and the average salary of the average Briton.

I somehow suspect they would see this as unfair and unnecessary.

But they should put up or shut up.

Let he who is without sin cast the first stone.

Meanwhile, in more important news, my chum mad inventor John Ward is building a giant catapult for Sunday’s World Egg Throwing Championships in Lincolnshire.

Now THAT is important news.

I know whom I would like to see as the primary target for the eggs.

And it ain’t the perfectly law-abiding Jimmy Carr.
